Rental Agreement

Terms & Conditions

The term “client” or “renter” shall refer to the name on the contract below. The term “our”, “us” or “company” shall refer to Bay Area Event Rentals. SEVERABILITY: The provider of this rental contract shall be severable, so that the unenforceability, or waiver of the provisions shall not affect the remaining provisions. 

CANCELLATION:

Bay Area Event Rentals recognizes that plans can and do change, sometimes on short notice. If there is a change in client’s plans, e.g. cancellation or postponement of the event, Bay Area Event Rentals will take reasonable steps to book a substitute event or events and/or make other alternative arrangements. In the event, however, Bay Area Event Rentals is unable to do so, in whole or in part, it reserves the right to retain up to any and all amounts paid or due as of the date of receiving notice of the change.

Responsibility of Use and

disclaimer of Warranties

RESPONSIBILITY OF USE & DISCLAIMER OF WARRANTIES: The client/renter is responsible for the use of the rented items. The client/renter assumes all risks inherent to the operation and use of rented items, and agree to assume the entire responsibility for the defense of, and to pay, indemnity and hold Bay Area Event Rentals harmless from and hereby release Bay Area Event Rentals from, and all claims for damage to property or bodily injury (including death) resulting from use, operation or possession of the items, whether or not it be claimed or found that such damage or injury resulted in whole or part from Bay Area Event Rental’s negligence, from the defective condition of the items, or any other cause. THE CLIENT/RENTER AGREES THAT NO WARRANTIES EXPRESSED OR IMPLIED, INCLUDING MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE HAVE BEEN MADE IN CONNECTION WITH THE EQUIPMENT RENTED.

PAYMENTS

Client/Renter shall provide final payment at the time of delivery to and will be made by cash, check venmo or Zelle

RETURNED CHECKS: There will be a $35.00 charge on any returned checks for any reason.

ADDITIONAL CHARGES: In addition to other charges and cost provided herein, client/renter shall pay charges in accordance with company rates then in effect for the following services: Delivery or Pickup Delivery or Pickup from any location to other than ground level Pickups or Deliveries between 12am-9am Setup and Breakdown Delivery and pickup after business hours and Holidays Packaging materials not returned Service Calls Site Planning and Preparation

RESERVING EQUIPMENT:

Equipment will be reserved upon receipt of a signed and completed rental contract and deposit of 25% of total charges. This deposit is non-refundable and will be paid by cash, check or money order only. THE RENTAL OF THIS EQUIPMENT CANNOT BE SUBRENTED OR USED BY OTHERS, ONLY THE CLIENT LISTED BELOW ON CONTRACT.

EQUIPMENT FAILURE:

The client/renter agrees to immediately discontinue use of rented items should it at anytime become unsafe or in a state of disrepair, and will immediately (one hour or less) notify Bay Area Event Rentals of the facts. Bay Area Event Rentals agrees at our discretion to make the items operable within a reasonable time, or provide a like item if available, or make a like item available at another time, or adjust rental charges. The provision does not relieve client/renter from obligations of contract. In all events Bay Area Event Rentals shall not be responsible for injury or damage resulting from failure or defect of rented items.

Client/Renter shall maintain, at renter’s liability, property and casualty insurance coverage in amount sufficient to protect Bay Area Event Rentals and its equipment against any and all claims, loss, or damage of whatever nature or type.

Bay Area Event Rentals will strive to accommodate client delivery request; however, delays and changes in the schedule are sometimes unavoidable. We try to communicate any scheduling changes as they occur. All items will be delivered and picked up at a designated location. The client or client’s assigned representative must be available to count all items upon delivery and pickup; otherwise, Bay Area Event Rentals’ counts will be considered accurate.

Items are delivered a reasonable distance from the truck. Stairs, Elevators and other labor intensive deliveries are an additional charge starting at $50. Items are left stacked and should be re-stacked in the same location prior to pick-up. If you would like the rental items to be set-up and broken down you may request this service when you place your order and we will provide you a quote. We cannot add this set-up and breakdown service to your contract at the time of delivery. 

DELIVERY & SET UP:

INSURANCE:

EQUIPMENT RESPONSIBILITY & CREDIT CARD REQUIREMENTS:

Client/renter is responsible for equipment from time of possession to time of return. Client/Renter assumes the entire risk of loss, regardless of cause. A Valid Credit card is required to rent. All information must be included and signature filled out at location on bottom of this rental contract. If items are lost, stolen, damaged, renter will assume all costs of replacement or repair, including all labor costs. Client/renter shall pay a reasonable cleaning charge for rented items returned permanently damaged or dirty. Charges billed to the credit card will consist of missing or damaged items or charges left unpaid after 10 days of event. A detailed invoice of those charges and copy of receipt will be emailed to you after the event. Client hereby authorizes Bay Area Event Rentals to charge this credit card.

TIME OF RETURN: Client/renters right of possession terminates upon the expiration of the rental period set forth on contract. Time is of the essence in this contract. Any extension must be agreed upon in writing. LATE RETURNS: Client/renter shall return rented items to Bay Area Event Rentals during regular business hours, promptly upon, or prior to expiration of rental period. If client/renter does not timely return, the rental rate shall continue until all items are returned.

USE OF EQUIPMENT:

Client/renter agrees & covenants to be satisfied with the instruction and condition of equipment rented and of the proper and safe use of equipment, or that renter is so familiar and conveyed to Bay Area Event Rentals you were. Client/renter further agrees that the items will be used only at the address listed on contract, and only for the purpose for which it was intended and manufactured. Subleasing or improper use is prohibited. Renter/client agrees they have read all instruction manuals, operating instructions and warnings related to rented items.

SITE PREPARATION

Please be sure your site is ready. (lawns mowed, furniture moved, vehicles moved, etc.) before the crew is scheduled to arrive. If the site is not ready or accessible when the crew arrives, the client will incur an additional fee. Bay Area Event Rentals will not be liable for any damages or injury at event.

MISSING OR DAMAGED ITEMS:

Missing or damaged items will be charged to the credit card at replacement cost. A detailed invoice of these items will be provided to client. A short list of a few replacement fees are outlined below. This list is not comprehensive and may include additional items that are not listed. Missing/permanently damaged white folding Chairs will be charged at a replacement fee of $15.00 per chair. Missing/permanently damaged white Padded Chairs will be charged at a replacement fee of $45.00 per chair. Missing/permanently damaged Tables will be charged at a replacement fee of $65.00 per table.

Making Changes to the order

You may make revisions to your order by close of 14 business days prior to delivery. Should you need to make revisions less than two (14) days prior to delivery. Additional charges will apply. Please note that all orders are considered final at the close of (14) business days prior to delivery.

By completing the deposit required, you the client are agreeing to all of the above.
